Terms of Service

1. Agreement

By creating an account or using FormPesa at formpesa.online, you agree to these Terms. If you use FormPesa for a business, you agree on behalf of that business.

2. The service

FormPesa lets you build forms, collect responses, and accept M-Pesa payments via STK Push. Payments are initiated through payment providers you connect (Fortpesa, Safaricom Daraja, PalPluss) and settle directly to your M-Pesa account. FormPesa never holds, custody, or transmits your funds.

3. Your account

  • You must provide accurate information and keep your credentials secure.
  • You are responsible for all activity under your account.
  • You must be at least 18 years old and legally able to enter this agreement.
  • One person or business entity may not abuse free-tier limits or share accounts to circumvent plan quotas.

4. Acceptable use

You may not use FormPesa to:

  • Collect payments for illegal goods or services
  • Phish, spam, or impersonate others
  • Upload malware or attempt to breach security
  • Violate Kenyan law or the terms of M-Pesa / your payment provider
  • Resell or white-label the service without a written agreement

5. Plans & billing

Free and paid plans are described on our pricing page. Paid plans are billed via M-Pesa STK Push. Plan fees are non-refundable once the billing period has started, except where required by law. We may change plan pricing with 30 days' notice.

6. Your content

You own the forms, responses, and content you create. You grant FormPesa a limited licence to host, process, and display that content solely to operate the service for you.

7. Payment providers

Your use of Fortpesa, Daraja, or PalPluss is governed by their own terms. FormPesa is not responsible for provider downtime, transaction failures, or settlement delays outside our control.

8. Availability

We aim for high uptime but do not guarantee uninterrupted service. We may suspend accounts that violate these Terms or that pose a security risk.

9. Disclaimer & limitation of liability

The service is provided "as is". To the maximum extent permitted by law, FormPesa disclaims all warranties and is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or KES 1,000 if you are on the free plan.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that breach these Terms. On termination, your access ends; we retain data only as required by law or our Privacy Policy.

11. Governing law

These Terms are governed by the laws of Kenya. Disputes will be resolved in the courts of Kenya.
